Baze rides world-best 11,000th winner

(08-14) 20:48 PDT -- When Russell Baze became the first jockey in North America to reach 10,000 winners, he addressed the crowd at Golden Gate Fields on Feb. 1, 2008.

"It's a milestone, but it's not the final milestone," Baze said. "In about three years I should be standing here again."

But Baze took only 2 1/2 years to reach a world-best 11,000, which he did in Saturday's fourth race at the Sonoma County Fair.

Unlike his 10,000th winner, which came by a short nose, Baze didn't have to work hard for No. 11,000 as well-bred first-time starter Separate Forest won the $29,250 maiden-allowance event for fillies and mares by 11 lengths. Separate Forest is trained by Richard Mandella - like Baze, a member of thoroughbred racing's Hall of Fame - who sent the daughter of Forestry from his base at Del Mar.

Baze, 52, was the second jockey in the world to reach 10,000. Brazilian rider Jorge Ricardo made it Jan. 9, 2008, but he has since missed time with injuries and stands at 10,830. Retired Laffit Pincay is second in North America with 9,530 winners.

"When you think about it, 11,000 is a ridiculous number," Baze said after he won the Real Good Deal Stakes with Goggles McCoy on Wednesday at Del Mar for his 10,996th. "I'm just a guy who is lucky enough to be doing something I love; to have enough ability to do it well, and have had enough luck where I've been able to avoid the big injuries and losing a lot of time. It's just all worked out."

When New York Yankees slugger Alex Rodriquez was approaching his 600th career home run recently, the story captivated the media in all corners of the sporting world. It didn’t seem to matter that A-Rod admitted to steroid use early in his career, making this milestone something of a farce, or that he ranks no higher than seventh on the all-time list of career home runs.

Compare the media coverage of that story to Saturday’s accomplishment by Hall of Fame jockey Russell Baze, horse racing’s all-time winningest jockey. Baze guided first-time starter Separate Forest to an 11-length win in the fourth race at Northern California’s Sonoma County Fair, his 11,000th career victory.

The National Thoroughbred Racing Association did send out a one-sentence "alert," stating:

"Jockey Russell Baze registered the 11,000th win of his career when he guided Separate Forest to victory in today’s 4th race at Santa Rosa (Sonoma County Fair)." The Paulick Report received no press releases from the Sonoma County Fair (in the last 20 years I don’t recall receiving any press releases from a Northern California racetrack about anything, so that’s no surprise). There were no photos distributed showing Baze in the winner’s circle holding up a big sign with "11,000 wins," and little coverage other than the industry trade publications (and Chuck Dybdal provided excellent coverage in Daily Racing Form).

Perhaps if Baze was riding in New York or Southern California the accomplishment might have received some mainstream media coverage

BROOKLYN - North Bergen blogger and Internet shock jock Harold "Hal" Turner was convicted yesterday of threatening to kill three Chicago judges in comments made in a blog post last year.

The jury of four men and eight women took less than two hours to decide Turner's fate.

This was the third time Turner stood trial on the charge, with the first two trials ending in deadlocked juries.

"We the jury unanimously find the defendant Harold Turner, as charged in the single count of the indictment, guilty," the jury foreman read in the courthouse at 3:30 yesterday afternoon. Deliberations began at 1:45 p.m.

Judge Donald Walter then ordered Turner immediately incarcerated, saying that he is considered a danger to the community.

Turner's mother, Kathy Diamond, whose eyes were already welling with tears in the front row, said "I love you" and Turner turned to her and said "I love you, too." Two marshals stood at Turner's side at the defense table. His teen son said "Love you, Dad."

Turner showed little reaction to the verdict and within minutes he was led out a side door of the courtroom. Just before that, he took off his tie and removed the wallet from his pocket and asked they be given to his family.

A sentencing date has not been set.

Assistant U.S. Prosecutor Diane MacArthur and defense attorney Peter Kircheimer refused to comment as they left the building.

Earlier in the day, after the jury received its instructions from the judge, Diamond said: "It's in the hands of God now, and we are all praying."

The threat that ultimately got Turner convicted was made in response to a ruling by the appellate court judges that upheld a handgun ban. In his blog post, Turner said that the judges "deserved to be killed."

The government saw this as a threat. Turner, who worked for the FBI for a time as an informant to ferret out the extremist groups that gravitated toward his website broadcasts and blog, contended that it was merely an opinion.

Diamond said the verdict was entirely too quick for something so important and said she was shocked her son was immediately taken into custody because he had appeared wherever and whenever he was ordered to do so.

"Why wouldn't they give him a chance to say goodbye to his family?" Diamond said as she began to cry outside the courthouse. "I couldn't even hug him."

His 16-year-old son said he was outraged and shocked by the verdict. "He didn't threaten anybody. He opined."

Several jurors who left the courthouse refused to comment.

Earlier in the day, Turner's FBI handler testified that Turner's violent rhetoric on his show and blog post was always a problem for the FBI.

Special Agent Stephen Haug said when Turner was terminated as an informant in 2006 it was "due to constantly ignoring of the admonishments to stop with the violent rhetoric."

Haug said that on the occasions when Turner asked him if his rhetoric had crossed the line of criminality, "My standard response was always the same, 'I don't have a warrant for you.'"

Haug also testified that Turner provided unique and valuable information to the FBI during his time as an informant, often related to the white supremacist community and domestic terrorism.

Consumers now owe more on their student loans than their credit cards.
Americans owe some $826.5 billion in revolving credit, according to June 2010 figures from the Federal Reserve. (Most of revolving credit is credit-card debt.) Student loans outstanding today — both federal and private — total some $829.785 billion, according to Mark Kantrowitz, publisher of FinAid.org and FastWeb.com.

Students are becoming more heavy debtors “The growth in education debt outstanding is like cooking a lobster,” Mr. Kantrowitz says. “The increase in total student debt occurs slowly but steadily, so by the time you notice that the water is boiling, you’re already cooked.”

By his math, there is $605.6 billion in federal student loans outstanding and $167.8 billion in private student loans outstanding. He estimates that $300 billion in federal student loan debts have been incurred in the last four years.
Partially, this is a story about Americans paying down credit card debt. Some are seeking a new frugality, but many credit card companies are raising minimum monthly payments or cutting off new and existing lines that consumers in the past may have turned to during tough times. Revolving credit, the majority of which is credit card debt, reached a high in September 2008 of $975.7 billion, according to Fed data. A consumer who juggles both credit-card and student-loan debt is likely to pay of the credit-card first, as that debt tends to carry a higher interest rate.

In terms of volume, a person is likely to borrow more money to go to school today than, say, spend on necessities using a credit card during a patch of unemployment. Tuition at public and private four-year universities last year went as high as $26,000, with additional fees for housing and books not showing any signs of letting up either. It’s no surprise that many parents, reeling from the downturn, would turn to borrowing to make up the difference. With the cost of education increasing rapidly and the duration of unemployment increasing, perhaps the surprise is that this turning point didn’t hit earlier.

Student Loan Justice
, a Washington State-based student loan advocacy group issued a statement on the student-loan eclipse, estimating that media coverage of credit cards exceeds coverage of student loans “by a factor of approximately 15-to-1 based on unscientific news surveys conducted since 2007.”

But student loan debt, in many ways, is different than credit-card debt. These loans typically can’t be discharged in bankruptcy. They have different repayment terms, some of which can catch some have heavy consequences for borrowers who miss payments and borrowers’ families.

90% of Black Children on Food Stamps

In one of the most dramatic examples I've seen of the true reach of hunger in the United States, a
new report released this week by Washington University in St. Louis researchers found that 90 percent of black children will be clients of the national Supplemental Nutrition Assistance Program (SNAP/Food Stamps) at least once by the time they turn 20.
Although the percentage is less for white children (the only other ethnic group studied), the startling statistic here is that, at some point before their 20th birthday,
50 percent of all children in the United States will have received SNAP benefits.
More than being about access to food, the report's lead researcher says his findings represent a more important trend in the upbringing of the country's children. "Rather than being a time of security and safety, the childhood years for many American children are a time of economic turmoil, risk, and hardship," says Mark Rank, Ph.D.
Among the other interesting/disturbing statistics presented in the report:
-Nearly one-quarter of all American children will be in households that use food stamps for five or more years during childhood.
-91 percent of children with single parents will be in a household receiving food stamps, compared to 37 percent of children in married households.
-Looking at race, marital status and education simultaneously, children who are black and whose head of household is not married with less than 12 years of education have a cumulative percentage of residing in a food stamp household of 97 percent by age 10.
What this report really highlights are the drastic race, gender and socio-economic disparities in this country. And unfortunately, these disparities seem to be affecting our youth at a staggering level.
If children really are the future (as I believe they are), we as a society need to do a much better job of letting kids develop into the leaders of tomorrow, instead of being held back by the problems of today.

IN 2000 four Americans were charged with importing lobster tails in plastic bags rather than cardboard boxes, in violation of a Honduran regulation that Honduras no longer enforces. They had fallen foul of the Lacey Act, which bars Americans from breaking foreign rules when hunting or fishing. The original intent was to prevent Americans from, say, poaching elephants in Kenya. But it has been interpreted to mean that they must abide by every footling wildlife regulation on Earth. The lobstermen had no idea they were breaking the law. Yet three of them got eight years apiece. Two are still in jail.
America is different from the rest of the world in lots of ways, many of them good. One of the bad ones is its willingness to lock up its citizens (see our
briefing). One American adult in 100 festers behind bars (with the rate rising to one in nine for young black men). Its imprisoned population, at 2.3m, exceeds that of 15 of its states. No other rich country is nearly as punitive as the Land of the Free. The rate of incarceration is a fifth of America’s level in Britain, a ninth in Germany and a twelfth in Japan.

Some parts of America have long taken a tough, frontier attitude to justice. That tendency sharpened around four decades ago as rising crime became an emotive political issue and voters took to backing politicians who promised to stamp on it. This created a ratchet effect: lawmakers who wish to sound tough must propose laws tougher than the ones that the last chap who wanted to sound tough proposed. When the crime rate falls, tough sentences are hailed as the cause, even when demography or other factors may matter more; when the rate rises tough sentences are demanded to solve the problem. As a result, America’s incarceration rate has quadrupled since 1970.
Similar things have happened elsewhere. The incarceration rate in Britain has more than doubled, and that in Japan increased by half, over the period. But the trend has been sharper in America than in most of the rich world, and the disparity has grown. It is explained neither by a difference in criminality (the English are slightly more criminal than Americans, though less murderous), nor by the success of the policy: America’s violent-crime rate is higher than it was 40 years ago.
Conservatives and liberals will always feud about the right level of punishment. Most Americans think that dangerous criminals, which statistically usually means young men, should go to prison for long periods of time, especially for violent offences. Even by that standard, the extreme toughness of American laws, especially the ever broader classes of “criminals” affected by them, seems increasingly counterproductive.
Many states have mandatory minimum sentences, which remove judges’ discretion to show mercy, even when the circumstances of a case cry out for it. “Three strikes” laws, which were at first used to put away persistently violent criminals for life, have in several states been applied to lesser offenders. The war on drugs has led to harsh sentences not just for dealing illegal drugs, but also for selling prescription drugs illegally. Peddling a handful can lead to a 15-year sentence.
Muddle plays a large role. America imprisons people for technical violations of immigration laws, environmental standards and arcane business rules. So many federal rules carry criminal penalties that experts struggle to count them. Many are incomprehensible. Few are ever repealed, though the Supreme Court recently pared back a law against depriving the public of “the intangible right of honest services”, which prosecutors loved because they could use it against almost anyone. Still, they have plenty of other weapons. By counting each e-mail sent by a white-collar wrongdoer as a separate case of wire fraud, prosecutors can threaten him with a gargantuan sentence unless he confesses, or informs on his boss. The potential for injustice is obvious.
As a result American prisons are now packed not only with thugs and rapists but also with petty thieves, small-time drug dealers and criminals who, though scary when they were young and strong, are now too grey and arthritic to pose a threat. Some 200,000 inmates are over 50—roughly as many as there were prisoners of all ages in 1970. Prison is an excellent way to keep dangerous criminals off the streets, but the more people you lock up, the less dangerous each extra prisoner is likely to be. And since prison is expensive—$50,000 per inmate per year in California—the cost of imprisoning criminals often far exceeds the benefits, in terms of crimes averted.

article). Britain’s new government is proposing to replace jail for lesser offenders with community work. Some parts of America are bucking the national trend. New York cut its incarceration rate by 15% between 1997 and 2007, while reducing violent crime by 40%. This is welcome, but deeper reforms are required.
America needs fewer and clearer laws, so that citizens do not need a law degree to stay out of jail. Acts that can be regulated should not be criminalised. Prosecutors’ powers should be clipped: most white-collar suspects are not Al Capone, and should not be treated as if they were. Mandatory minimum sentencing laws should be repealed, or replaced with guidelines. The most dangerous criminals must be locked up, but states could try harder to reintegrate the softer cases into society, by encouraging them to study or work and by ending the pointlessly vindictive gesture of not letting them vote.
It seems odd that a country that rejoices in limiting the power of the state should give so many draconian powers to its government, yet for the past 40 years American lawmakers have generally regarded selling to voters the idea of locking up fewer people as political suicide. An era of budgetary constraint, however, is as good a time as any to try. Sooner or later American voters will realise that their incarceration policies are unjust and inefficient; politicians who point that out to them now may, in the end, get some credit.

The blasts, heard blocks away, interrupted a warm summer evening that had drawn children out onto their neighborhood blocks Wednesday.
In the 11500 block of South Perry Avenue in West
Pullman, neighbors said they watched in horror as a gunman pumped bullet after bullet into a 13-year-old boy who was already down on the street.
And this morning, a stricken mother made frantic calls to loved ones, asking them to come be with her as she tried to adjust to her new world.
"I'm not going to see my baby no more," Theresa Lumpkin cried. "How soon can you get here? Try to get into
Chicago."
Lumpkin's son, Robert Freeman Jr., was shot and killed Wednesday in what family and neighbors say was likely a case of mistaken identity. No one was in custody as of late Thursday afternoon.
Police sources said the boy may have been mistakenly targeted.
Although initial reports indicated that Robert, who was most recently enrolled at Oglesby Elementary School, was riding his bike Wednesday, Lumpkin said her son was standing with friends near a car when he was shot by an assailant who ran out from a gangway.
Lumpkin was already surrounded by family and friends Thursday as she remembered her son. He loved basketball and had cut his forehead just weeks ago when the backyard rim came down on him during a dunk. He liked to tinker with machines.
He spent part of the summer cutting lawns with a mower his father gave him, spending earned cash on treats like Flamin' Hot Cheetos. He was new on the block, but he had made friends and rode his bicycle constantly.
But Lumpkin kept returning to the last image she had of her son -- dying in the middle of the street.
"My baby was just lying there,'' she said, crying. "He tried to get up. He tried to fight for his mama. He tried to fight for his life.''
Neighbors, who did not want their names published, heard the shots and came to the front of their house and saw the gunman standing over Robert, shooting repeatedly.
"I was running out [of] the door to say, 'Stop shooting that baby,'" one neighbor said. The resident said he was incensed to see the young teen targeted.
"That boy's young,'' he said. "That's a baby.''
Lumpkin said doctors told her that Robert's body had 22 bullet holes. While it was not clear exactly how many times Robert was shot, the approximate number of bullet holes he suffered was confirmed by police sources.
Neighbors said Robert had a similar haircut, complexion and height as another boy in the neighborhood who they think was the target.
Police are also investigating a theory that the shooter targeted the wrong teen and that the motive for the shooting was a dispute over drugs or money, several sources said.
Robert was the fourth teen shot in the area in a week. In neighboring
Roseland, a 15-year-old was shot Tuesday, a 17-year-old was shot Monday and a 14-year-old was shot Sunday. None of the injuries was life-threatening.
This latest round of gunfire sent one mother from two blocks away racing to Perry Avenue to find her own teen son.
After the resident, who did not want to be named, found her son, she took him straight home, where she tried to reassure him.
"I told him it was going to be OK," the mother said. "He said, 'You told me that before.'"

For Third Time, Blogger Charged With Menacing Judges Goes on Trial

Round three of the United States versus Harold "Hal" Turner, the Internet shock jock charged with threatening to kill three Chicago appeals judges, begins this morning in Brooklyn federal court.

Turner was arrested last June after writing on his blog that three judges on the 7th U.S. Circuit Court of Appeals -- Richard Posner, William Bauer and Frank Easterbrook -- "deserve to be killed" for their opinion in N.R.A. v. Chicago, 08-4241, which upheld handgun bans in Chicago and Oak Park, Ill.

"Their blood will replenish the tree of liberty," Turner wrote in June 2009. "A small price to pay to assure freedom for millions." Turner, who hosted a weekly Webcast from his home in North Bergen, N.J., also posted the judges' photographs, work addresses and phone numbers, and promised to soon add their home addresses.

The U.S. Attorney's Office for the Northern District of Illinois charged Turner with threatening to kill the three judges.

The case, United States v. Turner, 09-cr-00650, was assigned to Judge Donald Walter, who sat on assignment from the U.S. District Court for the Western District of Louisiana. Walter transferred the case to Brooklyn, then came along to hear it.

The first two trials ended in mistrials.

In Turner I, the jury did not hear testimony from the three allegedly threatened judges, and voted 9-3 to acquit. Leaving the courthouse, a juror complained to reporters, "The prosecution's case was so weak. He just bailed out. He had a whole slough of witnesses. Why did the government only call six witnesses?"

The prosecution, led by Assistant U.S. Attorney William Hogan, apparently heard that complaint, and for the second trial flew the three appellate judges to New York to testify about the alleged threats.

Although Judge Posner's appearance was the most widely anticipated, Judge Easterbrook's made for the best theater. He told the jury that after reading Turner's posts, his "principal concern was that somebody would try to come kill me or shoot me or blow me up."

Turner's attorney, Michael Orozco, asked Judge Easterbrook, "If [N.R.A. v. Chicago] is overturned, doesn't that make Hal Turner correct?"

The judge replied that Orozco clearly did not understand the U.S. Constitution and then offered a lengthy disquisition on the history of the Second Amendment. Turner's "blog post says any judge who decides a case incorrectly should be assassinated," Judge Easterbrook concluded. "That is not the way the system works."

In the end, the judges' appearances did not provide sufficient help and the jury again failed to reach a verdict, although its vote was not disclosed.

Judge Walter ordered a third trial, for which a jury is scheduled to be selected this morning. Opening arguments may begin as early as this afternoon.

Much has changed in the five months since Turner II.

Minutes after that jury was released, Orozco informed the court that he and his co-counsel, Chicago solo practitioner Nishay Kumar Sanan, had been fired. Turner now will be represented by the Brooklyn Federal Defender's office. The office's chief, Peter Kirchheimer, will try the case. Kirchheimer did not return a call for comment.

And in June, the U.S. Supreme Court reversed the decision that spurred Mr. Turner's alleged threats, N.R.A. v. Chicago, and remanded the case to the 7th Circuit.

However, Hogan, the lead prosecutor, said Monday that there have been no major developments since Turner II, and that he expects the three judges to take the stand again as early as Wednesday.

Orozco said he considered the Supreme Court's reversal of N.R.A. v. Chicago a vindication. "Apparently it was Judge Easterbrook that didn't understand the U.S. Constitution," Orozco said. "Their decision was overturned. They got it wrong. Hal Turner was correct. His analysis was correct."

Asked to handicap the third trial, Orozco said that, after the testimony of the three judges proved insufficient, the prosecution will try to add a new twist to the case, but that he expected Kirchheimer to win an acquittal. "I'm sure he has some bombs to lob their way," Orozco said. "Of course, I mean that in the colloquial sense."
